The short version. lastwake is free. Your ledgers are yours — we claim no ownership and only store and display them for you. Don’t break it, don’t abuse it, don’t use it to host anything unlawful. It is offered as-is, with no promise that it will always be up.
These Terms are an agreement between you and XenVault Interactive (“we”, “us”, “our”), based in Ukraine, covering the lastwake website at lastwake.com and the Lastwake applications for Android and iOS (the “Service”). By using the Service you accept them. If you do not, do not use the Service.
1. What the Service is
lastwake is a personal watchlist: a set of curated ledgers of Chinese dramas and films you can stamp as found or watched, and your own shelves on which you keep whatever titles you like, with a status, a rating and a private note. Catalogue details and poster images come from The Movie Database. The Service hosts no video and no copyrighted media — it keeps a list, nothing more.
2. Eligibility
You must be at least 16 years old to create an account. By creating one you confirm that you are, and that the information you gave us is accurate.
3. Your account
- One person, one account. Keep your password to yourself and do not let anyone else use your account.
- You are responsible for what happens under your account. Tell us promptly at the address in §12 if you think it has been compromised.
- Your nickname is assigned at random and cannot be chosen or changed. It carries nothing derived from your identity, which is the point of it.
- You can delete your account at any time from your account page. Deletion is immediate and irreversible; see the Privacy Policy for exactly what is erased.
4. Your content
You own what you write. Your shelves, ledger names, ratings and notes remain yours. We claim no ownership of them and we do not use them to train machine-learning models.
You grant us only the narrow, revocable, royalty-free licence we need to operate the Service: to store your content, to transmit it back to you on your devices, and — for a shelf you have explicitly chosen to share — to display it at the link you published, minus your private notes. That licence ends when you delete the content or your account.
You are responsible for what you put in. Do not upload anything you have no right to, and do not put personal information about other people into a note.
5. Shared links
Publishing a shelf creates a read-only page at an unguessable address that anyone holding the link can open, without an account. Private notes and your identity are never included. Treat the link as public: anyone you send it to can pass it on, and we cannot recall a copy already made. You can revoke it at any time, which disables the page immediately.
6. Acceptable use
Do not:
- break into, probe or disrupt the Service, or try to reach data that is not yours;
- scrape it, or drive it with automated tools beyond ordinary personal use, or work around rate limits;
- use it to store or distribute unlawful, infringing, harassing or malicious material;
- resell it, or pass its data off as your own product;
- misrepresent your identity, or create accounts in bulk.
Rate limits and a signup bot check exist because our upstream quotas are finite. Circumventing them spoils the Service for everyone.
7. Third-party material
Catalogue metadata and poster images are supplied by The Movie Database and belong to their respective owners. This website uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB. The TMDB logo appears on this site only to identify that source, and its use implies no endorsement or approval by TMDB. Title and cover art appear under their own rights holders’ terms.
The Service also links out to sites we do not control. We are not responsible for their content or their practices.
8. Availability and changes
The Service is free, run by one person, and offered without any guarantee of uptime. We may change, suspend or discontinue any part of it — or all of it — at any time. If we retire the Service entirely we will make reasonable effort to warn you first so you can export or copy your ledgers.
9. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy of catalogue data, or uninterrupted or error-free operation. Keep your own copy of anything you would be sorry to lose.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost data, lost profits or lost opportunity, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for it in the preceding twelve months — which is nothing, as it is free — or 50 EUR.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your mandatory statutory rights are unaffected by these Terms.
11. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate an account that breaks these Terms, that endangers the Service or other users, or where we are required by law to do so — normally with notice, and immediately where the breach is serious. Sections 4 (your ownership), 9, 10 and 13 survive termination.
12. Apps distributed through Google Play and the App Store
The mobile apps are distributed by Google and Apple, but this agreement is between you and us alone — the stores are not parties to it and are not responsible for the apps or for support. On iOS, Apple is a third-party beneficiary of these Terms and may enforce them against you; if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, which is zero, and beyond that has no other warranty obligation. Your use is also subject to the store’s own terms of service.
13. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, and disputes fall to the competent courts of Ukraine. If you are a consumer resident in the EU, the UK or another jurisdiction that grants you the protection of your local mandatory law and the right to sue locally, nothing here takes that away from you.
14. Changes to these Terms
We may revise these Terms. The date at the top changes with them, and material changes will be announced in the Service before they take effect. Continuing to use the Service after that means you accept the revised Terms; if you do not, delete your account.
15. General
If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign this agreement; we may assign it as part of a transfer of the Service, on notice to you. These Terms and the Privacy Policy are the entire agreement between us about the Service.
